How to Submit a Notice of Claimed Infringement
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of those works.
- Identification of the material that is claimed to be infringing, with enough information to allow us to locate it: specifically, the full URL(s) of the allegedly infringing material.
- Information reasonably sufficient to contact you: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Send completed notices to the designated agent above. We may be unable to act on notices that are missing any required element, and will request the missing information before taking any action.
Our Response to Valid Notices
- We acknowledge receipt of the notice to the complainant.
- We forward the notice to the customer hosting the material and provide a short cure window (typically 48 hours) to respond or remove the material.
- If the customer does not remove the material or submit a valid counter-notice, we disable access to the specific URL(s) identified. We use the narrowest means available (file rename, access rules, or restoring from a clean backup). We do not suspend entire accounts for a single DMCA notice unless the customer is unresponsive or there is a pattern of infringement.
- All DMCA actions are logged.
Counter-Notices
If you are a customer whose material was removed or disabled and you believe the removal was in error or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g). A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Nova Grid Hosting LLC may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have filed an action seeking a court order, we may restore the material.
Repeat-Infringer Policy
In accordance with 17 U.S.C. § 512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts of customers who are repeat infringers. We track DMCA strikes against each customer account. Three valid DMCA strikes within a 12-month period will result in account termination, subject to human review.
Trademark, Defamation, and Other Complaints
The DMCA covers copyright only. For trademark complaints, defamation claims, privacy violations, or other non-copyright concerns, contact abuse@novagridhosting.com. Do not submit these to the DMCA agent; they will delay the response.
